दिल्ली पुलिस द्वारा दर्ज की गई एफआईआर के मुताबिक, न्यूज़क्लिक के आरोपी जिसकी कथित तौर पर चीनी प्रचार को बढ़ावा देने के लिए चीन से जुड़ी संस्थाओं की जांच की जा रही है, भारत की “संप्रभुता और क्षेत्रीय अखंडता” को “कमजोर” करने के लिए “लगातार गैरकानूनी गतिविधियों” में शामिल थे। एफआईआर में कहा गया है कि न्यूज़क्लिक के स्वामित्व और रखरखाव वाले पीपुल्स डिस्पैच पोर्टल का इस्तेमाल एक साजिश के तहत कथित तौर पर जानबूझकर पेड न्यूज के माध्यम से जम्मू-कश्मीर और अरुणाचल प्रदेश के बारे में गलत खबरें फैलाने के लिए करोड़ों रुपये की अवैध विदेशी फंडिंग के लिए किया गया था।

एफआईआर में दर्ज आरोपियों में तीन लोग प्रमुख रूप से जिम्मेदार हैं. न्यूज़क्लिक के संस्थापक संपादक प्रबीर पुरकायस्थ, गौतम नवलखा और नेविल रॉय सिंघम। यह एफआईआर 17 अगस्त को दिल्ली पुलिस स्पेशल सेल के निरीक्षक प्रवीन कुमार की शिकायत पर गैर-कानूनी गतिविधि रोकथाम अधिनियम (यूएपीए) और भारतीय दंड संहिता की धारा 153 ए, 120 बी के तहत दर्ज की गई है।
Xiaomi और Vivo जैसी बड़ी चीनी टेलीकॉम कंपनियों ने भारत में अवैध रूप से विदेशी फंड लाने के लिए विदेशी मुद्रा प्रबंधन अधिनियम (FEMA) का उल्लंघन करते हुए भारत में हजारों शेल कंपनियों को शामिल किया। एफआईआर में कहा गया है कि ये दोनों कंपनियां भारत विरोधी इस साजिश का हिस्सा हैं। ये दोनों सैंकड़ों फर्जी कंपनियों के जरिए भारत में अवैध रूप से विदेशी धन लाए हैं और भारत के पीएमएलए और फेमा कानून का उल्लंघन किया है।
इस पूरी साजिश में गौतम भाटिया को मुख्य किरदार बताते हुए कहा गया है कि उन्होंने प्रबीर पुरकायस्थ और अन्य चीन समर्थकों को कानूनी मसलों से सुरक्षा देने के लिए एक लीगल नेटवर्क बनाया था। ताकि भारत विरोधी साजिश में लगे लोगों और कंपनियों को कानूनी सुरक्षा मिले।
एफआईआर में कहा गया है कि प्रबीर, नेविल रॉय सिंघम और उनकी कंपनी से जुड़े कुछ कर्मचारियों के बीच ई-मेल पर बातचीत हुई। जिसमें इस बात का खुलासा हुआ है कि ये लोग अरुणाचल और कश्मीर को भारत के नक्शे से बाहर करने पर बात कर रहे थे। राष्ट्रीय और अंतरराष्ट्रीय स्तर पर इन दोनों जगहों को विवादित हिस्से के रूप में प्रचारित करना चाहते थे।

एफआईआर के अनुसार, भारतीय संस्थाओं और विदेशी प्रतिष्ठानों ने भारतीय अर्थव्यवस्था को कई सौ करोड़ रुपये का नुकसान पहुंचाने के उद्देश्य से किसानों के विरोध को समर्थन और वित्त पोषण करने की साजिश रची।
एफआईआर में कहा गया है कि आरोपियों ने केंद्र सरकार के कोविड-19 प्रबंधन के प्रयासों को बदनाम करने के लिए झूठी कहानियां प्रचारित कीं और 2019 के आम चुनाव में तोड़फोड़ करने की साजिश रची।
इसमें आरोप लगाया गया, “आरोपियों ने साजिश के माध्यम से उपरोक्त कृत्यों को अंजाम देने के लिए अवैध रूप से विदेशी धन जुटाने के लिए कई कंपनियों का उपयोग करके अवैध और घुमावदार मार्गों के माध्यम से अवैध लेनदेन का जाल बिछाया है।”
अप्रैल 2018 से न्यूज़क्लिक को अवैध तरीकों से करोड़ों रुपये की विदेशी धनराशि प्राप्त हुई है।
ये धनराशि नेविल रॉय सिंघम द्वारा धोखाधड़ी से जुटाई गई थी, जिसे एफआईआर में “चीन की कम्युनिस्ट पार्टी का सक्रिय सदस्य” बताया गया था।
गौतम नवलखा – न्यूज़क्लिक में एक शेयरधारक – कथित तौर पर भारत विरोधी गतिविधियों में शामिल था और सक्रिय रूप से प्रतिबंधित नक्सली संगठनों का समर्थन कर रहा था और पाकिस्तान की इंटर-सर्विसेज इंटेलिजेंस (आईएसआई) के एक जासूसी एजेंट के साथ सांठगांठ कर रहा था।
आरोप है कि न्यूज़क्लिक के कर्मचारियों और मालिकों ने जम्मू-कश्मीर और अरुणाचल प्रदेश को “विवादित क्षेत्र” के रूप में दिखाने के इरादे से चीन में लोगों के साथ ईमेल साझा किए।
एफआईआर में कहा गया है, “अवैध रूप से लाए गए विदेशी फंड को प्रबीर पुरकायस्थ और उनके सहयोगियों जोसेफ राज, अनूप चक्रवर्ती (अमित चक्रवर्ती के भाई), बप्पादित्य सिन्हा (वर्चुनेट सिस्टम्स प्राइवेट लिमिटेड के प्रमोटर) द्वारा निकाल लिया गया है।”
इसमें आगे आरोप लगाया गया, “यह भी पता चला है कि ये धनराशि गौतम नवलखा और तीस्ता सीतलवाड के सहयोगियों, जावेद आनंद, तमारा, जिब्रान, उर्मिलेश, अरात्रिका हलदर, परंजय गुहा ठाकुरता, त्रिना शंकर और अभिसार शर्मा को वितरित की गई थी।”
