दिल्ली की पटियाला हाउस कोर्ट ने आप सांसद राघव चड्ढा को टाइप-VII बंगला खाली करने का आदेश दिया है। कोर्ट ने कहा है कि राघव चड्ढा यह दावा नहीं कर सकते कि आवंटन रद्द होने के बाद भी उन्हें अपने कार्यकाल के दौरान सरकारी आवास पर कब्जा जारी रखने का पूर्ण अधिकार है। अदालत सांसद और राज्यसभा सचिवालय के बीच टाइप-VII बंगले के आवंटन को लेकर एक मामले की सुनवाई कर रही थी। सांसद का दिल्ली के पंडारा रोड पर टाइप-VII बंगले का आवंटन मार्च में राज्यसभा सचिवालय द्वारा रद्द कर दिया गया था। उन्हें बताया गया कि आवंटन रद्द कर दिया गया है क्योंकि टाइप-VII पहली बार सांसद के रूप में उनकी पात्रता से अधिक था और उन्हें इसके बदले एक दूसरा फ्लैट आवंटित किया गया था।

इसके बाद, राघव चड्ढा ने राज्यसभा सचिवालय के खिलाफ दिल्ली के पटियाला हाउस कोर्ट का दरवाजा खटखटाया और अप्रैल में बेदखली के खिलाफ स्थगन आदेश प्राप्त किया। इसके बाद राज्यसभा सचिवालय ने चड्ढा की याचिका का विरोध करते हुए एक आवेदन दायर किया और तर्क दिया कि अदालत सचिवालय को सुने बिना आदेश पारित नहीं कर सकती है।
राज्यसभा सचिवालय के वकील ने दलील देते हुए कोर्ट में कहा था कि राज्यसभा सांसद होने के नाते राघव चड्ढा को टाइप-VI बंगला आवंटित करने का अधिकार है, न कि टाइप-VII बंगला। राज्यसभा सचिवालय के नोटिस के खिलाफ राघव चड्ढा कोर्ट पहुंच गए थे। इस मामले में पटियाला हाउस कोर्ट ने राघव चड्ढा को बंगला खाली करने के मामले में लगाई अंतिम रोक को अब हटा दिया है। साथ ही कोर्ट ने राज्यसभा सचिवालय के बंगला खाली करने के नोटिस को सही ठहराया है।
अदालत ने कहा कि सरकारी बंगले का आवंटन केवल उन्हें दिया गया विशेषाधिकार है और आवंटन रद्द होने के बाद भी राघव चड्ढा को इमारत पर कब्जा जारी रखने का कोई निहित अधिकार नहीं है।
मालूम हो कि राघव चड्ढा को जुलाई 2022 में टाइप-VI बंगला आवंटित किया गया था। अगस्त 2022 में, उन्होंने टाइप-VII आवास के आवंटन के लिए राज्यसभा सभापति से संपर्क किया। फिर उन्हें दिल्ली के पंडारा रोड पर टाइप-VII आवास बंगला आवंटित किया गया। राज्यसभा सदस्य पुस्तिका के अनुसार, पहली बार सांसद बने चड्ढा टाइप-वी आवास के हकदार हैं। जो सांसद पूर्व केंद्रीय कैबिनेट मंत्री, पूर्व राज्यपाल या पूर्व मुख्यमंत्री और पूर्व लोकसभा अध्यक्ष हैं, वे टाइप-VII बंगले के हकदार हैं।
